Namefinity Terms of Service

Namefinity is a private app for helping you remember people, with your in-app content stored on your device. Use it respectfully, including in work and networking contexts, do not use it for illegal or harmful purposes, keep your own exports/backups private, and do not rely on the app as your only copy of important information.

Acceptance of these terms

By downloading, accessing, or using Namefinity, you agree to these Terms. If you do not agree, do not use the app.

We may update these Terms to reflect legal, product, or operational changes. If we do, we will update the effective date. Continued use after updated Terms are posted means you accept the updated Terms.

App Store terms

Namefinity is licensed, not sold, through the Apple App Store. Apple’s Licensed Application End User License Agreement applies to your use of the iOS app unless a different app-store agreement applies. These Terms supplement that license for Namefinity-specific conduct, privacy, content, and support rules.

Eligibility

Namefinity is not directed at children under 13. If you are under 13, or under the minimum digital-consent age where you live, use the app only with permission and supervision from a parent or legal guardian.

Your use of the app

You may use Namefinity for personal or internal professional memory and learning purposes.

You must not:

Namefinity is not designed for emergency communications, legal compliance, medical decisions, safety-critical uses, or life-saving instructions.

Your content and responsibility

You retain whatever rights you have in the names, photos, notes, tags, and other information you choose to store in Namefinity. Because your in-app content stays on your device unless you export or share it, we do not receive or review that content.

You are responsible for:

The app includes delete, trash, and export tools, but local device loss, uninstalling the app, storage failure, or a bad restore can still cause data loss. Namefinity is not a substitute for your own backup practices.

Photos, detection, and no recognition

Namefinity may use on-device face detection to crop or position a photo. Detection means "there is a face here." The app does not perform face recognition, does not identify people automatically, and does not create or store faceprints or biometric templates.

Exports, backup files, and sharing

Text export, QR sharing, and restore are user-initiated actions. You decide where exported files go and who sees your QR card.

Backup files are readable and not encrypted in this version. They can contain people and photos. Store them somewhere private.

Intellectual property

Namefinity, including its design, code, branding, original text, app-provided pack content, and other materials, is owned by Lucid And Company Ltd. or its licensors. You receive a limited, non-exclusive, non-transferable license to use the app as provided through the App Store.

You must not copy, redistribute, sell, lease, sublicense, or exploit the app or app-provided content except as allowed by these Terms, the App Store rules, or applicable law.

Feedback

If you send us feedback, bug reports, or feature ideas, you allow us to use them without restriction or compensation. Do not send confidential information in feedback unless we have agreed to receive it.

Privacy

Our Privacy Policy explains what the app stores locally, what anonymous usage statistics may be sent to Aptabase, what basic technical diagnostics Google may receive from on-device text and face-detection components, and how to turn Namefinity's own anonymous statistics off.

Payments and future paid features

Namefinity v1 is free. If we later add subscriptions, one-time purchases, or other paid features, payments will be handled through the App Store or another platform payment provider where required. We do not collect or store full payment card details. Refunds are handled by the store or payment provider unless applicable law requires otherwise.

Changes, suspension, and discontinuation

Because v1 has no account system, there is no account for us to suspend. We may still discontinue the app, remove features, stop support, or terminate your license to use the app if you materially breach these Terms.

You can stop using the app at any time by deleting it from your device. Deleting the app deletes local app data from that device.

Disclaimers

Namefinity is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

Practice scheduling, imported text suggestions, photo positioning, and reminders may be incomplete, inaccurate, delayed, or unavailable. You are responsible for checking important information before relying on it.

Limitation of liability

To the maximum extent allowed by law, Lucid And Company Ltd. and its affiliates, officers, employees, contractors, and licensors are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost data, lost profits, business interruption, or reputational harm, arising from your use of or inability to use Namefinity.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Lucid And Company Ltd. and its affiliates, officers, employees, contractors, and licensors from claims, damages, losses, liabilities, and expenses arising from your misuse of the app, violation of these Terms, violation of law, or infringement of another person’s rights.

Compliance with laws

You are responsible for complying with the laws that apply where you use the app. You may not use Namefinity where doing so is prohibited.

Governing law

These Terms are governed by the laws of Hong Kong, unless consumer-protection law in your place of residence requires otherwise. Courts in Hong Kong will have jurisdiction, except where applicable law gives you the right to bring claims elsewhere.
